Judge Koh finds Samsung infringement of Apple patents was not willful, won't triple damages

Judge Lucy Koh has decided on several post-trial motions from Samsung and Apple in their long running patent case, overturning one key element of the jury's ruling while upholding several others. What was overturned was the jury's ruling that Samsung's acts of patent infringement were willful, which meant Judge Koh could have tripled some parts of the $1 billion+ in damages granted to Apple. On the other hand, she also rejected Samsung's request for a new trial, and invalidated two claims a wireless patent it holds. Naturally of course, it's not over yet (it's never over) as each company can still appeal elements of the ruling, and other appeals in the case are already ongoing.

(AP) ? U.S. regulators said Wednesday they asked Boeing Co. to provide a full operating history of lithium-ion batteries used in its grounded 787 Dreamliners after Japan's All Nippon Airways revealed it had repeatedly replaced the batteries even before overheating problems surfaced.

National Transportation Safety Board spokesman Peter Knudson said the agency made the request after recently becoming aware of battery problems at ANA that occurred before a Jan. 7 battery fire in a 787 parked at Boston's Logan International Airport. Boeing has already collected some of the information, he said.

ANA said it had replaced batteries on its 787 aircraft some 10 times because they failed to charge properly or showed other problems, and informed Boeing about the swaps. Japan Airlines also said it had replaced 787 batteries. It described the number involved as a few but couldn't immediately give further details.

All 50 of the Boeing 787s in use around the world remain grounded after an ANA flight on Jan. 16 made an emergency landing in Japan when its main battery overheated.

Lithium-ion batteries are prone to overheating and require additional safeguards to prevent fires. However, ANA spokeswoman Megumi Tezuka said the airline was not required to report the battery replacements to Japan's Transport Ministry because they did not interfere with flights and did not raise safety concerns.

Having to replace batteries on aircraft is not uncommon and was not considered out of the ordinary, she said.

Laura Brown, a spokeswoman for the U.S. Federal Aviation Administration, said in Washington that the agency was checking whether the previous battery incidents had been reported by Boeing.

With 17 of the jets, ANA was Boeing's launch customer for the technologically advanced airliner. The airline has had to cancel hundreds of flights, affecting tens of thousands of people, but has sought to minimize disruptions by switching to other aircraft as much as possible.

The battery problems experienced by ANA before the emergency landing were first reported by The New York Times.

Japanese and U.S. investigators looking into the Boeing 787's battery problems shifted their attention this week from the battery-maker, GS Yuasa of Kyoto, Japan, to the manufacturer of a monitoring system. That company, Kanto Aircraft Instrument Co. makes a system that monitors voltage, charging and temperature of the lithium-ion batteries.

On Tuesday, the U.S. National Transportation Safety Board said it was conducting a chemical analysis of internal short circuiting and thermal damage of the battery that caught fire in Boston.

The probe is also analyzing data from flight data recorders on the aircraft, the NTSB said in a statement on its website.

(AP) ? The massive blimp-like aircraft flies but just barely, hovering only a dozen feet off a military hangar floor during flight testing south of Los Angeles.

Still, the fact that the hulking Aeroscraft could fly for just a few minutes represents a step forward in aviation, according to the engineers who developed it. The Department of Defense and NASA have invested $35 million in the prototype because of its potential to one day carry more cargo than any other aircraft to disaster zones and forward military bases.

"I realized that I put a little dot in the line of aviation history. A little dot for something that has never been demonstrated before, now it's feasible," said flight control engineer Munir Jojo-Verge.

The airship is undergoing testing this month at Marine Corps Air Station in Tustin, and must go through several more rounds of flight testing before it could be used in a disaster zone or anywhere else. The first major flight test took place Jan. 3.

The biggest challenge for engineers is making sure the airship will be able to withstand high winds and other extreme weather conditions, Jojo-Verge said.

Worldwide Aeros, the company that developed the aircraft, said it also must secure more funding for the next round of flight testing, but is hopeful the Defense Department and others will step in again as investors.

The company says the cargo airship's potential to carry more cargo more efficiently than ever before would provide the U.S. military with an advantage on the battlefield and greater capacity to save more lives during natural disasters.

The lighter-than-air vehicle is not a blimp or a zeppelin because it has a rigid structure made out of ultra-light carbon fiber and aluminum underneath its high-tech Mylar skin. Inside, balloons hold the helium that gives the vehicle lift. Unlike hydrogen, the gas used in the Hindenburg airship that crashed in 1937, helium is not flammable.

The airship functions like a submarine, releasing air to rise and taking in air to descend, said Aeros mechanical engineer Tim Kenny. It can take off vertically, like a helicopter, then change its buoyancy to become heavier than air for landing and unloading.

"It allows the vehicle to set down on the ground. And then when we want to become lighter than air, we release that air and then the vehicle floats and we can allow it to take off," Kenny said.

The project has set abuzz the old hangars at the Marine Corps Air Station in Tustin. The structures were built to hold blimps during World War II. Now workers zip around in cherry-pickers, and the airship's silvery surface shines against the warm tones of the aging wood of the walls.

"You could take this vehicle and go to destinations that have been destroyed, where there's no ports, no runways, stuff like that. This vehicle could go in there, offload the cargo even if there's no infrastructure, no landing site for it to land on, this vehicle can unload its whole payload," said Kenny.

Next, Aeros wants to build a full-size 450-foot-long vehicle that can carry 66 tons of payload.

Kyocera Torque coming to Sprint's Direct Connect lineup in March, we go hands-on (video)

Going to be in the market for a new Direct Connect device soon, but the current offerings seem so... drab? Enter the Kyocera Torque, the latest Sprint smartphone featuring the network's CDMA-based Push-to-Talk service. The phone, which should be available sometime in early March, brings with it LTE connectivity, (mostly) stock Android 4.0, a 1.2GHz dual-core Snapdragon S4 Plus processor, HD Voice, 4-inch WVGA display, 4GB internal storage and a 2,500mAh battery. As you'd come to expect on a Direct Connect device, it's also certified mil-spec 810G and IP67 and is water-resistant (it can be in one meter of water for up to 30 minutes). It's also the first on this side of the Pacific to utilize Kyocera's Smart Sonic Receiver tissue-conduction tech, a system that foregoes the traditional earpiece and transmits audio to your ear via vibration.

The Torque packs a lot of average features that would likely put it somewhere in the mid-range (we haven't been given pricing yet), but it's definitely not going to win any beauty awards -- it's still a Direct Connect device, after all. Its outer layer is dressed with Dura-Grip and the phone is plenty bulky as a result; however, it's also much more durable than your standard piece of electronics. We threw the phone at the wall, slammed it repeatedly on the table, dunked it in water and even let it sit in ice for at least 20 minutes, all without incident.

On the software side, the Torque uses a version of stock Android 4.0 with only a small amount of tweaking. Essentially, the only major change added in by Sprint and Kyocera is Eco Mode, a power management system on the Torque that blocks background data connections for nonessential apps. Ivory Coast stampede survivors tell of New Year horror

ABIDJAN, Ivory Coast -- Survivors of a stampede in Ivory Coast that killed 61 people, most of them children and teenagers, after a New Year's Eve fireworks display, said Wednesday that makeshift barricades stopped them from moving along a main boulevard, causing the crush of people.

Ivory Coast President Alassane Ouattara ordered three days of national mourning and launched an investigation into the causes of the tragedy but two survivors, in interviews with The Associated Press, indicated why so many died in what would normally be an open area, the Boulevard de la Republic.

An estimated 50,000 people had gathered in Felix Houphouet Boigny Stadium and elsewhere in Abidjan's Plateau district to watch the fireworks. As they streamed away from the show some encountered blockades.

"Near the Justice Palace we were stopped by some people who built wooden blockades in the street," 33-year-old Zoure Sanate said from her bed in Cocody Hospital.

"They told us we must stay in the Plateau area until morning. None of us accepted to stay in Plateau until the morning for a celebration that ended at around 1 a.m.," she told the AP.

"Then came the stampede of people behind us," she said. "My four children and I were knocked to the ground. I was hearing my kids calling me, but I was powerless and fighting against death. Two of my kids are in hospital with me, but two others are missing. They cannot be found."

Another hospital patient, Brahima Compaore, 39, said he also was caught in the pile of people stopped by the roadblock.

"I found myself on the ground and people were walking on me," Compaore told the AP. "I was only saved by people who pulled me onto the sidewalk."

Set up by thieves?
Local newspapers are speculating that thieves set up the roadblocks so that pickpockets could steal money and mobile phones from the packed-in people.

Ouattara pledged to get answers. Some observers wondered why police did not prevent the tragedy.

"The investigation must take into account all the testimonies of victims," he said Wednesday. "We will have a crisis center to share and receive information."

Ouattara also postponed the traditional New Year's receptions at his residence, which had been scheduled for Thursday and Friday.

Advocate: Incident was unsurprising
The leader of a human rights organization said that deadly incidents were predictable because the police and civil authorities had not taken adequate protective measures.

"The situation is deplorable," said Thierry Legre, president of the Ivorian League of Human Rights. "It is our first tragedy of 2013 but in 2012 we could already see possibility of such a tragedy because there are not adequate authorities patrolling our roads and waters."

He called on the government "to implement measures to avoid such tragedies in the future by reinforcing the civil protection system."

Just one night before the New Year's incident, there had been a big concert at the Felix Houphouet-Boigny Stadium where American rap star Chris Brown performed. That Sunday night event was for the Kora Awards for African musicians. No serious incidents were reported from that event.

Event intended to celebrate peace
The government organized the fireworks to celebrate Ivory Coast's peace, after several months of political violence in early 2011 following disputed elections.

In 2009, 22 people died and over 130 were injured in a stampede at a World Cup qualifying match at the Houphouet Boigny Stadium, prompting FIFA, soccer's global governing body, to impose a fine of tens of thousands of dollars on Ivory Coast's soccer federation. The stadium, which officially holds 35,000, was overcrowded at the time of the disaster.

GOP lawmakers in Sandy-hit areas blast House colleagues

New Jersey Governor Chris Christie blasts House speaker John Boehner for delaying a vote on funding Superstorm Sandy clean-up efforts, and New York Rep. Michael Grimm discusses the continuing fallout.

The House GOP came under a blistering bipartisan assault Wednesday for punting on Sandy relief, with Republican New Jersey Gov. Chris Christie complaining he couldn?t even get Speaker John Boehner to return his calls.

Fallout from the surprise vote pullback on a $60 billion aid package mounted by the hour with cries of outrage and calls for revenge.

By late afternoon, it seemed like the onslaught was having an effect. The House scheduled a Friday vote on $9 billion in funds, to be followed by a Jan. 15 vote on another $51 billion.

It was unclear if that would mollify the New York and New Jersey politicians who unleashed unusually personal attacks against Boehner and other House Republicans.

Earlier, New York Rep. Pete King said his Republican colleagues had exposed a bias against the blue states of the Northeast and that anyone from the area who donates money to them ?should have his head examined.?

?They can?t count on any vote from me now,? he said on MSNBC.

Christie, who has been touted as a possible White House contender, put the blame for the delay squarely on Boehner and marveled that he called the Ohioan four times before he would take his call.

?Shame on you, Congress,? he said, adding that he has received no explanation for the ?disappointing and disgusting? decision.

The $60 billion request for assistance for to victims of Superstorm Sandy has been passed by the Senate, and House supporters were pushing for a Tuesday night vote.

Instead, King said, Boehner ?just walked off? the floor and had an aide break the news that there would be no vote. The House adjourned on Wednesday without considering the measure; lawmakers are back Thursday for an hour before they gavel in the 113th Congress.

While some Republicans have criticized the aid package for funds not directly linked to Sandy, Boehner spokesman Michael Steel said the speaker is ?committed to getting this bill passed this month.?

That promise didn?t quiet the fury.

?Totally obscene,? said Tom Jordan, a former firefighter whose house in Rockaway, Queens, was flooded by the storm that killed 120 people and damaged almost 400,000 homes. ?

?They?re quibbling about $60 billion? That?s nothing as far as the federal budget goes. They should come down here and see what the beach looks like. They want to wait? We need repairs before the next hurricane season.?

Rep. Michael Grimm, a Republican who represents parts of Staten Island and Brooklyn, called the delay ?a personal betrayal.? Sen. Kirsten Gillibrand dared Boehner to visit Staten Island, then added that she doubts ?he has the dignity nor the guts to do it.?

?They?re a bunch of idiots,? Staten Island Borough President James Molinaro, a Conservative, said of House Republicans. ?There?s no other logical reason they?d be doing this.?

In a joint statement, Christie and New York?s Gov. Andrew Cuomo, a Democrat, accused the house of a ?dereliction of duty.?

?When American citizens are in need we come to their aid,? they said. ?That tradition was abandoned in the House last night.?

But it was King who really let his Republican colleagues have it.

?The fact is that the dismissive attitude that was shown last night toward New York, New Jersey and Connecticut typifies, I believe, a strain in the Republican Party,? he said on the House floor.

?I can?t imagine that type of indifference, that cavalier attitude being shown to any other part of the country,? he added.

?We cannot believe this cruel knife in the back was delivered to our region? This is not the United States of America! This should not be the Republican Party. This should not be the Republican leadership.?

Although he said he is not thinking of switching parties, King suggested New Yorkers should hit House Republicans who don?t support the bill where it hurts ? in the campaign coffer.

?These people have no problem finding New York when it comes to raising money. They only have a problem when it comes to allocating,? he fumed.

In an address to fellow lawmakers in the House of Representatives, Rep. Peter King, R-N.Y., blasts Speaker of the House John Boehner for failing to hold a vote on Senate-passed legislation that would provide relief for victims of Superstorm Sandy.

?If this is not delivered and very quickly?anyone from New York or New Jersey who contributes one penny to congressional Republicans after this should have their head examined,? he added on MSNBC.

Boehner is supposed to meet with Republican members of the New York and New Jersey delegations on Wednesday to reassure them that the relief bill will be passed.

But King expressed skepticism about a quick vote, noting a majority of House Republicans don?t support the bill and Washington will be soon be preoccupied with the inauguration and the State of the Union.

President Obama called on the House to?bring the bill to a vote?immediately and ?pass it without delay for our fellow Americans.?

It?s unclear what impact the vote delay with have. The head of the Federal Emergency Management Agency testified this month that it had enough funding to ?respond to the immediate needs.?

Rep. Darrell Issa (R-California) defended Boehner?s move, blaming the Senate for padding the relief package with non-essential funding.

?The Senate didn?t do their job. They sent us a bunch of pork, and then left town,? he said on ?Fox and Friends.?

New Year, New Tech, Same Old Problems

Yet, there are several places that haven't been touched much by technology, or at least places where technology hasn't gone far enough. Here are a few markets where I'd personally like to see innovators continue to push the limits.

Fisker sues insurance company over 338 cars, $33M, lost in Sandy ...

On the tail end of a very difficult year for electric car company Fisker, the company reveals that its insurance claim for 338 Karmas, worth $33 million, was denied by the insurance company, and Fisker is now suing XL Insurance America in court.

Electric car startup Fisker Automotive has filed a lawsuit charging insurance company XL Insurance America with breach of contract for denying coverage of its claim after 338 of its Karma cars were destroyed due to flooding in Superstorm Sandy. The cars were valued by Fisker to be worth $33 million, and Reuters first reported the lawsuit (which I?ve embedded below).

The 338 cars were being held at Port Newark in New Jersey, and during the storm, the cars were ?submerged in more than five feet of seawater, resulting in their complete destruction,? says Fisker in the suit. XL denied coverage of the claim on Dec. 20, 2012, and Fisker filed the lawsuit on Dec. 28, 2012.

All I can say is yikes, for the company, which has faced innumerable setbacks and is now looking for a well-financed partner to help it develop and manufacture its second Atlantic car. 2012 was truly an ugly year for Fisker ? will 2013 turn things around for them?

Fiscal cliff negotiations stall; Senate to resume talks New Year's Eve

The U.S. Senate on Sunday ended the day still sharply divided over how to avoid the automatic? income-tax hikes and deep government spending cuts set to kick in Jan. 1 that could plunge the economy into a new recession.

Despite pleas from President Barack Obama and Republican House Speaker John Boehner for the Senate to resolve the stalemate, Democrat Harry Reid, the Senate Majority Leader, announced lawmakers would not return to work until 11 a.m. on Monday -- New Year's Eve -- for one last chance to avoid going over the so-called fiscal cliff.

Reid tried to sound a note of optimism, saying closed-door discussions would carry on.

?There is still significant distance between the two sides, but negotiations continue,? he said. ?There is still time left to reach an agreement and we intend to continue negotiations.?

But senators on both sides sounded less than optimistic as they emerged from separate closed-door meetings -- one for Democrats, one for Republicans.

"We've all been told not to make plans for New Year's Eve," Missouri Democratic Sen. Claire McCaskill told reporters.

Some said they remained hopeful.

The Senate's number two Democrat, Dick Durbin of Illinois,? told reporters he was "definitely" encouraged that Republicans had dropped a demand for reducing Social Security benefits as a condition for extending unemployment benefits set to expire for some two million Americans. Obama has said extending the unemployment benefits is one of his top priorities for any deal.

"Now that they?re backing off of it, maybe we can make some progress -- ?I hope," Durbin said.

Obama had previously offered to index Social Security benefits with a "chained" consumer price index -- essentially adopting a less generous measure of cost-of-living increases -- but only with safeguards for the poorest beneficiaries and only as part of a broader deficit-reduction plan.

Earlier, Republican Senate Minority Leader Mitch McConnell complained that Democrats had not yet given him a counteroffer to a GOP proposal delivered at 7 p.m. Saturday night. And McConnell spoke by telephone at least twice with Vice President Joe Biden in an effort to "jump-start" the stalled negotiations.

Even if McConnell and Reid could put together a last-minute compromise, that deal would still need to clear the Senate and the House of Representatives -- no mean feat with time running very short.

The two sides have been starkly at odds for the last year over which Bush-era income tax cuts to extend past their Jan. 1 expiration. Obama campaigned on letting taxes rise on income above $250,000, Republicans aim to set the threshold higher.

And the income tax threshold was far from the only bone of contention.

Obama and most Democrats want to extend unemployment benefits, but Republicans linked that request to the ?chained CPI? for Social Security. With that change off the table, it was not clear what would happen to the jobless help, Durbin said.

Obama and most Democrats want to see the estate tax paid on large inheritances rise. Republicans want to exempt more estates from what they call the ?death tax.?

The two sides are also looking at sparing millions of Americans from suddenly having to pay the Alternative Minimum Tax and eyeing a way to keep the reimbursement rate paid to doctors on Medicare-covered treatment from being slashed.

Maine Republican Sen. Olympia Snowe on Sunday blasted the last-minute negotiations as a "travesty" that had left American taxpayers disgusted and scared.

"It starts with beginning of this Congress -- in the last two years we?ve seen historic failure after historic failure," Snowe said.? "Both parties and both branches of government ... it imposes a tremendous hardship and burden on the average American."

Snowe, who is retiring after 34 years in Congress, has said the intense partisanship in Washington largely drove her decision to leave.
